Standard Terms and Conditions for LYOS Travel Application

 

These standard terms and conditions (“Terms and Conditions”) govern your use of the LYOS mobile travel app (“App”), developed and owned by LYOS Ltd (“LYOS”). By downloading, accessing, or using the App, you agree to be bound by these Terms and Conditions. If you do not agree with any provision of these Terms and Conditions, you must not use the App.

1. Use of the App

The LYOS App allows users to track their location and provides social network features for sharing visited places and user
ratings.
You must be at least 18 years old or have the consent of a legal guardian to use the app.
You may only use the App in compliance with applicable laws and regulations.
LYOS reserves the right to modify, update, or discontinue the App or any features at any time without prior notice.

2. User Permissions

By using the App, you agree to allow LYOS to collect and process location data while the App is in use, provided you have
granted the necessary permissions on your mobile device.
You understand and acknowledge that the accuracy of the location data may vary depending on factors beyond LYOS’s control,
including your device’s capabilities and environmental conditions.
You may enable or disable location tracking through the settings of the App or your mobile device.

3. Social Network Features

The App allows users to share visited places and rate them using the provided rating system.
By using the social network features, you acknowledge and agree that the information you share, including photos, comments,
and ratings, may be visible to other LYOS users and the general public
You are solely responsible for the content you share through the App and must ensure that it complies with applicable laws and
regulations, including copyright and privacy laws.
LYOS reserves the right to moderate, remove, or disable any content that violates these Terms and Conditions or is deemed
inappropriate, offensive, or unlawful.

4. User Content

You retain ownership of any content you share through the App.
By sharing content through the App, you grant LYOS a worldwide, non-exclusive, royalty-free, sublicensable, and transferable
license to use, reproduce, modify, adapt, publish, and display the content for the purpose of providing and improving the App’s
features and functionality.
You represent and warrant that you have all necessary rights to grant the license described in Clause 4.2 and that your content
does not infringe upon the rights of any third party

5. Privacy

LYOS’s use of your personal data is governed by its Privacy Policy, which is incorporated into these Terms and Conditions by
reference. By using the App, you consent to the collection, use, and disclosure of your personal data as described in the Privacy
Policy.

6. Intellectual Property

The App, including its design, features, and content, is protected by intellectual property laws and belongs to LYOS or its
licensors.
You may not copy, modify, distribute, sell, lease, or create derivative works based on the App or any part thereof unless
expressly permitted by these Terms and Conditions

7. Limitation of Liability

To the extent permitted by law, LYOS disclaims all warranties and liabilities arising from your use of the App, including but not
limited to the accuracy, reliability, and availability of the App’s features.
LYOS shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your
use of the App.

8. Indemnification

You agree to indemnify and hold LYOS harmless from any claims, damages, liabilities, costs, or expenses arising out of or in
connection with your use of the App, your violation of these Terms and Conditions, or your infringement of any rights of a third
party.

9. Termination

LYOS may terminate or suspend your access to the App at any time without prior notice and for any reason, including but not
limited to your breach of these Terms and Conditions.
Upon termination, your rights to use the App will cease, and you must immediately uninstall and delete the App from your
mobile device.

10. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the
courts of England and Wales.

11. Severability

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable, the remaining provisions shall
remain in full force and effect.

12. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and LYOS regarding your use of the App,
superseding any prior agreements or understandings.
By using the LYOS mobile travel app, you acknowledge that you have read, understood, and agreed to be bound by these
Terms and Conditions.
